These Terms of Use ("Terms") govern your access to and use of the DefenScope website, including defenscope.io and any related pages, forms, content, or online services operated by DefenScope LLC (collectively, the "Site").

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About DefenScope

DefenScope LLC ("DefenScope", "we", "us", or "our") is a Wyoming limited liability company providing cybersecurity consulting services, including services related to AI agent security, Model Context Protocol ("MCP") security, security architecture, security implementation, security assessments, and security testing.

2. Scope of These Terms

These Terms apply to your use of the Site, including:

  • viewing Site content;
  • submitting contact or assessment request forms;
  • requesting information about our services;
  • booking calls or consultations;
  • communicating with DefenScope through the Site; and
  • accessing materials, documentation, articles, diagrams, research, or other content published by DefenScope.

Cybersecurity consulting engagements, assessments, implementations, penetration testing, red teaming, or other professional services may be governed by a separate agreement, statement of work ("SOW"), master services agreement ("MSA"), order form, or other written agreement.

If a separate written agreement conflicts with these Terms regarding professional services, the separate agreement controls for those services.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site.

If you use the Site on behalf of a company or other organization, you represent that you have authority to act on behalf of that organization.

4. Informational Content

Content available through the Site is provided for general informational purposes.

Nothing on the Site constitutes:

  • a guarantee that a system is secure;
  • a certification of security or compliance;
  • legal advice;
  • regulatory advice;
  • financial advice;
  • a penetration test or security assessment;
  • a substitute for professional cybersecurity analysis specific to your environment.

Cybersecurity risks depend on architecture, configuration, operational practices, threat models, software versions, credentials, integrations, and other factors that cannot be fully evaluated through general Site content.

5. Professional Services

Descriptions of services, methodologies, timelines, deliverables, examples, diagrams, and outcomes presented on the Site are illustrative unless expressly incorporated into a written agreement.

Actual scope, deliverables, pricing, timelines, testing permissions, responsibilities, and limitations will be defined separately for each engagement.

Submitting an inquiry, requesting an assessment, or booking a call does not create a client relationship or obligate DefenScope to provide services.

No professional engagement begins until the applicable commercial and authorization requirements have been agreed by the parties.

6. Security Testing and Authorization

DefenScope performs security testing only where appropriate authorization exists.

If you request testing, analysis, or assessment of infrastructure, applications, AI agents, MCP servers, APIs, cloud environments, accounts, systems, or other assets, you represent that:

  • you own the relevant systems or have sufficient authorization from the owner;
  • you are authorized to permit the requested security activities;
  • the proposed testing does not violate applicable law or third-party rights; and
  • you will disclose relevant restrictions, dependencies, or third-party systems before testing begins.

DefenScope may require written authorization, rules of engagement, testing boundaries, emergency contacts, or other documentation before conducting security testing.

We may refuse or terminate work where authorization is unclear or where requested activity could create unacceptable legal, operational, or security risk.

7. Acceptable Use

You may not use the Site or DefenScope services to:

  • gain unauthorized access to systems, networks, accounts, or data;
  • conduct attacks against systems without authorization;
  • distribute malware, ransomware, credential-stealing software, exploits, or malicious payloads;
  • facilitate phishing, fraud, credential theft, or impersonation;
  • interfere with or disrupt the Site or its infrastructure;
  • bypass access controls, rate limits, or security mechanisms;
  • scrape, crawl, or automatically collect Site content in a manner that materially disrupts the Site;
  • submit malicious code or payloads through forms or other Site interfaces;
  • violate applicable laws, regulations, sanctions, or third-party rights;
  • misrepresent your identity, authority, affiliation, or ownership of systems; or
  • use DefenScope materials to falsely claim certification, endorsement, or approval by DefenScope.

Legitimate cybersecurity research, defensive testing, and security engineering are not prohibited where properly authorized and lawful.

8. Information You Submit

When submitting information through the Site, you agree to provide information that is accurate and that you are authorized to provide.

You should not submit passwords, API keys, access tokens, production credentials, private keys, confidential source code, highly sensitive personal information, or other secrets through general Site forms unless DefenScope specifically instructs you to do so through an approved secure channel.

You retain ownership of information you submit.

You grant DefenScope the limited right to process submitted information as reasonably necessary to:

  • respond to your inquiry;
  • evaluate a potential engagement;
  • provide requested services;
  • maintain security and prevent abuse; and
  • comply with legal obligations.

Handling of personal information is further described in our Privacy Policy.

9. Confidential Information

Submitting information through a general website form does not by itself create a confidentiality agreement or attorney-client, fiduciary, or similar privileged relationship.

Confidentiality obligations relating to professional engagements may be established through a nondisclosure agreement, MSA, SOW, or other written agreement.

DefenScope will nevertheless handle information submitted through the Site in accordance with our Privacy Policy and reasonable security practices.

10. Intellectual Property

The Site and its original content, including text, graphics, diagrams, branding, logos, layouts, software, documentation, security methodologies, and other materials, are owned by DefenScope or its licensors and are protected by applicable intellectual property laws.

Unless otherwise stated, you may view and use Site content for your own internal informational purposes.

You may not, without our prior written permission:

  • reproduce substantial portions of the Site;
  • commercially redistribute Site content;
  • remove copyright, trademark, or attribution notices;
  • present DefenScope content as your own;
  • use DefenScope branding in a way that implies endorsement or affiliation;
  • resell Site content or materials; or
  • create misleading derivative materials using DefenScope branding.

Nothing in these Terms transfers ownership of DefenScope intellectual property to you.

11. Feedback

If you voluntarily provide suggestions, ideas, or feedback concerning the Site or our services, you grant DefenScope the right to use that feedback without restriction or compensation.

This does not give DefenScope ownership of your confidential information, systems, code, or proprietary materials.

12. Third-Party Services and Links

The Site may contain links to or integrations with third-party websites, platforms, scheduling services, analytics tools, infrastructure providers, or other services.

Third-party services are governed by their own terms and privacy policies.

DefenScope does not control and is not responsible for third-party services, including their:

  • availability;
  • security;
  • accuracy;
  • content;
  • data handling practices; or
  • business practices.

A link or reference to a third party does not necessarily imply endorsement.

13. Security

We use reasonable administrative, technical, and organizational safeguards intended to protect the Site and information we process.

However, no website, communications system, cloud platform, or security control can be guaranteed to be completely secure.

You are responsible for using appropriate precautions when communicating sensitive information to us.

If you believe you have identified a security vulnerability affecting DefenScope, please contact us instead of attempting unauthorized exploitation or accessing data that does not belong to you.

14. No Guarantee of Security Outcomes

Cybersecurity assessments, architecture reviews, testing, recommendations, and security controls can reduce risk but cannot eliminate all risk.

Unless specifically stated in a separate written agreement, DefenScope does not guarantee that:

  • all vulnerabilities will be identified;
  • all attack paths will be discovered;
  • security controls will prevent every incident;
  • AI agents will always behave predictably;
  • prompt injection can be completely prevented;
  • third-party software or infrastructure will remain secure;
  • a system will satisfy every regulatory or compliance requirement; or
  • implementing recommendations will make a system completely secure.

Security findings reflect the systems, configurations, access, information, and testing scope available at the time of the engagement.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE."

DEFENSCOPE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • NON-INFRINGEMENT;
  • ACCURACY;
  • AVAILABILITY; AND
  • SECURITY.

We do not warrant that the Site will operate without interruption, errors, vulnerabilities, or harmful components.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEFENSCOPE LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE.

THIS INCLUDES, WITHOUT LIMITATION:

  • lost profits;
  • lost revenue;
  • lost business opportunities;
  • loss or corruption of data;
  • system downtime;
  • security incidents; or
  • reputational damage.

For claims arising solely from use of the Site and not from services governed by a separate written agreement, DefenScope's aggregate liability will not exceed USD $100.

Liability relating to paid professional services will be governed by the applicable MSA, SOW, order form, or other written agreement.

Nothing in these Terms excludes liability that cannot legally be excluded.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless DefenScope LLC and its members, employees, contractors, and affiliates from claims, damages, liabilities, and reasonable costs arising from:

  • your unlawful use of the Site;
  • your violation of these Terms;
  • security testing requested by you without sufficient authorization;
  • information or materials submitted by you in violation of third-party rights; or
  • your violation of applicable law.

This section does not apply to claims caused solely by DefenScope's own conduct where indemnification is prohibited by law.

18. Suspension and Termination

We may restrict, suspend, or terminate access to the Site where reasonably necessary to:

  • protect the Site or other users;
  • investigate suspected abuse;
  • comply with legal obligations;
  • respond to security threats; or
  • enforce these Terms.

You may stop using the Site at any time.

Sections that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, liability, indemnification, and governing law.

19. Privacy

Our collection and processing of personal information is governed by our Privacy Policy.

By using the Site, you acknowledge that information may be processed as described in that policy.

20. Export Controls and Sanctions

You may not use the Site or DefenScope services in violation of applicable export control, trade restriction, or sanctions laws.

DefenScope may decline to provide services where doing so could violate applicable legal or regulatory requirements.

21. Changes to the Site

We may modify, suspend, discontinue, or replace any part of the Site at any time.

We are not required to maintain any particular feature, page, service description, article, tool, or functionality indefinitely.

22. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Effective date" at the top of this page.

Material changes may also be communicated through the Site where appropriate.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms.

23. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

To the extent permitted by law, disputes arising solely from use of the Site will be subject to the exclusive jurisdiction of the state and federal courts having jurisdiction in Wyoming.

Professional services may be subject to different dispute resolution provisions where specified in a separate written agreement.

24. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

The unenforceable provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.

25. No Waiver

Failure by DefenScope to enforce any provision of these Terms does not waive our right to enforce that provision later.

26. Entire Agreement

These Terms and the Privacy Policy constitute the agreement between you and DefenScope regarding use of the Site.

They do not replace or modify any separately executed MSA, SOW, NDA, order form, or other written agreement governing professional services.
